Campbell plan faces additional hurdle in court

Another lawsuit was recently filed against the Campbell project, this one by Dr. Denim, a hip hop manufacturing company that says it wants to buy the Sears Building and convert it into a recording studio, retail store and manufacturing center for its hand-painted clothes.
For the motion to be approved, Melletz said, it required a majority of those present -- or four votes. Calvin Fisher, the planning board attorney, said he counted the abstention by planning board member John Gilliams as a yes vote.
That's improper, Melletz maintains. He says he has found three New Jersey court cases that support his view that abstentions cannot be counted as yes votes.
